Dispute and Refund Policy – INSTACALL LLC

INSTACALL LLC, a U.S.-based VoIP telecom service provider, operates on a prepaid model for all products and services. This policy outlines the terms under which disputes or claims for refunds will be considered, in compliance with U.S. and Delaware state law, as well as relevant banking regulations.

Refund Eligibility

  • Refund requests or claims will only be entertained if:
  • INSTACALL LLC is unable to provide the service purchased.
  • The customer is dissatisfied with the service provided and has given INSTACALL LLC the opportunity to address the issue.
  • Process for Initiating a Dispute or Refund Claim
  • To initiate a refund or dispute claim, the customer must submit a formal written request via mail, email, or facsimile, along with appropriate documentation that supports the claim. Claims must be submitted within a reasonable period following the issue’s occurrence.

 

Resolution of Dispute or Refund Claims

  • Upon receiving a formal dispute or refund claim, INSTACALL LLC, at its sole discretion, will decide whether to:
  • Issue a refund.
  • Reprovision the service.
  • Provide another form of resolution to address the customer’s concern.

Right to Cancel Service

INSTACALL LLC reserves the right to cancel a customer’s service at any time if it is determined that the customer has violated the company’s Acceptable Usage Policy (AUP). In such cases, the customer will not be entitled to a refund of any unused prepaid credit. The cancellation will be effective immediately upon notice from INSTACALL LLC.

 

Arbitration and Final Decision

If the customer is dissatisfied with INSTACALL LLC’s resolution, they may initiate binding arbitration through the American Arbitration Association (AAA). Both parties agree to abide by the AAA’s rules and procedures. The decision of the arbitrator will be final and conclusive.

 

Prohibition of Alternate Dispute Methods

Any attempt by the customer to resolve disputes through other means—such as filing a chargeback or dispute with a credit card company or financial institution—without following the procedures outlined in this policy will be considered a violation of the terms and conditions of service. Such actions may be deemed unlawful under relevant banking laws, including but not limited to U.S. and Delaware banking regulations.

 

Governing Law

This policy shall be governed by and construed in accordance with the laws of the State of Delaware. By using INSTACALL LLC’s services, the customer agrees to these terms and waives their right to pursue claims through alternate dispute resolution methods not specified herein.
